Requirements for Trademarks
The following are requirements to register trademarks in Costa Rica:
- Power of Attorney, duly signed and authenticated by a Notary Public. This document must be legalized by the Costa Rican Consul.
- If priority is solicited based on the Paris Convention, a certified copy of the application. The application must have been filed within the previous six months.
- Designs of the trademarks.
- Goods or services protected according to Nice Classification.
Requirements for Patents
- International Classification.
- Technological Sector.
- Name and personal data of each inventor.
- Power of Attorney, duly signed, notarized and legalized by the Costa Rican Consul.
- Assignment of the inventor(s), duly legalized and authenticated by the Costa Rican Consul. This document is necessary if the name of the applicant is different from the name of the applicant/owner in the country of origin.
- In order to file a PCT patent application, it is compulsory to file the translation of the PCT Patent Application, PCT Request, PCT International Preliminary Examination Report and PCT International Search Report.
- Translation of the document of grant of the country of origin.
- Five graphic representations or photographs of a Design or Model are necessary along with a short description of the same.
